Report: Court Overturns Death Penalty in Lithonia Murders

The Georgia Supreme Court upheld the murder conviction of Lithonia man who killed his wife and two children in Lithonia, but overturned the death penalty, according to media reports.

  The Georgia Supreme Court threw out a death penalty sentence for Clayton Jerrod Ellington, who was convicted of killing his wife and 2-year-old twin sons, the Atlanta Journal Constitution and other media reported.  The case will go back for a new sentencing trial after the court upheld the murder conviction, the AJC reported. Ellington in 2008 was sentenced to die for the 2006 murders of his wife, Berna, 31, and two sons, Christian and Cameron. The three were killed by hammer blows. The court voted unanimously to overturn the sentence, saying that the judge had improperly prevented his lawyers from asking prospective jurors if the death penalty would be their only consideration for punishment, the AJC said. Report: State Supreme Court Reinstates Woman's Vehicular Homicide Conviction for 2009 Incident at Princeton Elementary

Shirley Ogilvie was convicted of striking and killing a 7-year-old on his way to Princeton Elementary School.

According to an article on Ajc.com, the Georgia Supreme Court on Monday reinstated a woman's vehicular homicide conviction for hitting and killing 7-year-old Kameron Dunmore with her SUV three years ago as the student was walking in the crosswalk toward Princeton Elementary School, located at 1321 South Deshon Rd. in Lithonia. Shirley Ogilvie, of Snellville, according to news outlets, was convicted of two misdemeanors. The state's highest court determined the Court of Appeals to be in error when it overturned the conviction, Ajc.com reported.

Report: Stone Mountain Lawyer Disbarred

Supreme Court made the decision Tuesday to disbar Xavier Dicks, ajc.com reports.

Stone Mountain lawyer Xavier Dicks has been disbarred, ajc.com reports. Dicks was disbarred for abandoning a client, according to ajc.com. The article said the Georgia Supreme Court made the decision Tuesday. According to the article, the Supreme Court said in an opinion that Dicks in 2007 did not file a lawsuit on behalf of a client until after the statute of limitations for filing, in early 2008, and has paid only a portion of restitution. Dicks' office address is listed at 4820 Redan Rd.
